These Terms of Service ("Terms") govern your use of the ChurchApps platform operated by Live Church Solutions ("ChurchApps," "we," "us," or "our"), including B1.church, and all related services and applications.
By creating an account or using our services, you agree to these Terms.
1. About ChurchApps
ChurchApps is a free, open-source church management platform provided by Live Church Solutions, a 501(c)(3) nonprofit organization. Our mission is to provide free tools to churches so they can focus on ministry rather than software costs.
2. Accounts and Access
- Churches register for an account to use the platform. The person who registers the church is responsible for managing access for their organization.
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate information when creating an account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Acceptable Use
You agree to use ChurchApps only for lawful purposes related to church and ministry operations. You may not:
- Use the platform to store or distribute illegal content
- Attempt to gain unauthorized access to other accounts or systems
- Use the platform to send unsolicited bulk communications (spam)
- Reverse engineer or attempt to extract the source code of our proprietary services (note: our open-source code is freely available on GitHub under its respective license)
4. Data Ownership
Your data belongs to you. ChurchApps does not claim ownership of any data you enter into the platform. We process your data solely to provide the services described on our platform. See our Privacy Policy (https://churchapps.org/privacy) for full details on how data is handled.
5. Service Availability
ChurchApps is provided free of charge. While we strive for high availability, we do not guarantee uninterrupted service. We may perform maintenance, updates, or changes to the platform at any time. We will make reasonable efforts to notify users of planned downtime.
6. Open Source
The ChurchApps source code is available on GitHub (https://github.com/ChurchApps) under open-source licenses. Your use of the source code is governed by the applicable license in each repository. These Terms govern your use of the hosted platform, not the source code.
7. Donations and Payments
- ChurchApps integrates with Stripe for donation processing. Credit card and bank information is handled entirely by Stripe and is never stored on our servers.
- ChurchApps does not charge fees for use of the platform. Transaction fees charged by Stripe are separate and governed by Stripe's terms of service.
8. Limitation of Liability
ChurchApps is provided "as is" without warranty of any kind, express or implied. To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.
- Our total liability for any claim related to the service shall not exceed the amount you have paid us (which is zero for our free platform).
- We are not responsible for data loss due to circumstances beyond our reasonable control.
9. Indemnification
You agree to indemnify and hold harmless Live Church Solutions, its board members, volunteers, and contributors from any claims, losses, or damages arising from your use of the platform or violation of these Terms.
10. Termination
- You may stop using ChurchApps at any time. Church administrators can request deletion of their church's data by contacting support@churchapps.org.
- Individual members can delete their own accounts through the member portal.
- We may terminate or suspend access to accounts that violate these Terms.
- Upon termination, we will delete or anonymize your data in accordance with our Privacy Policy.
11. Data Processing Agreement
This section constitutes the Data Processing Agreement ("DPA") between ChurchApps (the "Processor") and the church using the platform (the "Controller"), as required by the UK/EU General Data Protection Regulation (GDPR).
11.1 Scope of Processing
ChurchApps processes personal data on behalf of churches solely to provide church management services. The categories of data processed include: member contact information, attendance records, donation records, group memberships, communication records, volunteer assignments, and uploaded photos. Data subjects include church members, attendees, and donors whose information is entered into the platform.
11.2 Processor Obligations
ChurchApps agrees to:
- Process personal data only on the documented instructions of the Controller (the church)
- Ensure that persons authorized to process personal data are bound by confidentiality obligations
- Implement appropriate technical and organizational security measures (as described in our Data Security documentation at https://support.churchapps.org/docs/b1-admin/settings/data-security)
- Not engage additional sub-processors without notifying the Controller (current sub-processors are listed in our Privacy Policy)
- Assist the Controller in responding to data subject requests using the platform's built-in tools (data export, anonymization, deletion)
- Notify the Controller without undue delay upon becoming aware of a personal data breach
- Delete or return all personal data upon termination of the service, at the Controller's choice
11.3 Controller Obligations
The church (Controller) agrees to:
- Ensure a lawful basis exists for the processing of personal data entered into ChurchApps
- Obtain any necessary consent from data subjects before entering their data
- Respond to data subject requests in a timely manner, using the tools provided by the platform
- Notify ChurchApps of any data protection requirements that may affect the processing
11.4 Sub-Processors
ChurchApps uses the following sub-processors:
- Amazon Web Services (AWS) — Data hosting and infrastructure (United States, us-east-2 region). Covered by the AWS Data Processing Addendum with Standard Contractual Clauses.
- Stripe — Payment processing for donations. Covered by Stripe's Data Processing Agreement.
11.5 International Transfers
Personal data is stored in the United States. Transfers from the UK/EU are governed by Standard Contractual Clauses (SCCs) as provided through the AWS Data Processing Addendum and Stripe's Data Processing Agreement.
11.6 Data Breach Notification
In the event of a personal data breach, ChurchApps will:
- Notify affected churches within 72 hours of becoming aware of the breach
- Provide details of the nature of the breach, the categories and approximate number of data subjects affected, and the measures taken to address the breach
- Cooperate with the church in meeting its notification obligations to supervisory authorities and data subjects
11.7 Data Deletion
Upon termination of a church's account:
- Church administrators may export all data before termination using the platform's export tools
- All personal data will be deleted or anonymized within 90 days of account termination
- Anonymized aggregate records (donation totals, attendance counts) may be retained for statistical purposes
12. Governing Law
These Terms are governed by the laws of the State of Oklahoma, United States, without regard to conflict of law provisions. For users in the European Union or United Kingdom, nothing in these Terms affects your rights under applicable local consumer protection or data protection laws.
13. Changes to These Terms
We may update these Terms from time to time. We will notify churches of significant changes by posting a notice on our platform. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
